RE: The tariff classification of steel beams from China

Dear Mr. Gomez:

In your letter dated October 1, 2016 you requested a tariff classification ruling.

The products you plan to import are described as hot rolled steel wide flange beams, cut to length ranging from 9 to 13 feet, punched and galvanized. The beams will be used as a foundation support for solar structures. A representative mill certificate was submitted which shows the chemistry of the product to meet the requirements of other alloy steel as defined in Note 1 (f) of Chapter 72, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for the the steel alloy beams will be 7228.70.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other bars and rods of other alloy steel; angles, shapes and sections, of other alloy steel; hollow drill bars and rods, of alloy or non-alloy steel: angles, shapes and sections: other. The rate of duty will be free.

It is noted that classification is dependent upon submission of a mill certificate for the product at time of entry which is consistent with the definition of alloy steel in Chapter 72 of the HTSUS. In addition, if at any point there is a question of the applicability of an antidumping or countervailing duty (AD/CVD) case, written decisions regarding the scope of AD/CVD orders are issued by the Enforcement and Compliance office in the International Trade Administration of the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs and Border Protection (CBP).

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
